Privacy statement from VXM Retail V.O.F.
VXM Retail is aware of the fact that appropriate processing of personal data is an indispensable aspect of privacy law. In order to guarantee this right, you can check in this statement what happens to your data. If you order a product from us, we obviously need some information from you. For example, without this information we can not send your product to you.
We also store data in case the product is not delivered, so that we can help you more quickly and are easily able to trace where it went wrong. The practice of VXM Retail is of course in accordance with the current Personal Data Protection Act and also with the General Data Protection Regulation that will take effect in May 2018. In view of the last point, it is quite possible that this privacy statement needs to be changed, because certain standards have a different meaning. It is therefore advisable that you consult this privacy statement from time to time. By a product at VXM Retail you agree to the general terms and conditions that apply and also the procedure with regard to the processing of personal data.
2 Processing purposes
To the (purchase) agreement between you and VXM Retail to perform as well as possible and to maintain a customer relationship, it is necessary to collect, use, share and document a number of your personal data. This is called 'processing' in the General Data Protection Regulation. We document this data in a careful manner and are of course appropriately secured.
3 Which data and why
If you decide to purchase a product from us and have this product delivered to your home, it is necessary that we receive and process some of your personal data before we can proceed with the delivery of the product.

If you are registered as a newsletter recipient in our (customer) file, we will send you newsletters in which we keep you informed of new products or offers. We use your e-mail address and account details to send you the newsletter. If you no longer wish to receive the newsletter, you have the right to make this known to us.

4 Retention periods
In accordance with the Personal Data Protection Act and the upcoming General Data Protection Regulation, VXM Retail retains your data no longer than necessary. VXM Retail bound to deadlines set by law and guarantees VXM Retail these terms much.
VXM Retail has a confidentiality obligation with respect to your personal data. This means that only the employees of VXM Retail or third parties with whom contractual agreements exist may have access to your personal data.
VXM Retail protects the data entrusted to it by technical and administrative security measures to minimize the risk of loss, misuse, unauthorized access, disclosure and modification. You can think of fi rewalls, encryption of data, and physical and administrative access checks up to the data and servers. If you think that data has been misused, you can contact us. 7 Sharing with third parties
For the execution of the agreement it is necessary that your data is shared with third parties. Agreements with regard to the collection and use of your personal data exist with these third parties. Sharing with third parties takes place in accordance with the laws and regulations of the Personal Data Protection Act and the upcoming General Data Protection Regulation. VXM Retail V.O.F. Never share, without your knowledge and consent, data with third parties for marketing purposes of third parties. Your personal data are shared with:
7.1 External seller
If the product you have purchased from us is not in stock, we will transfer the sale to an external seller if you wish. This seller will then continue to process the order. This requires, of course, that your data is provided to the external seller. Of course this will only happen with your consent.
7.2 Mail company
In order to ensure that your product actually reaches you, VXM Retail forced to share your name, address and possibly your telephone number with the postal company that delivers the ordered product to you. This data is only intended for this purpose and VXM Retail has contractual agreements with the postal company regarding the use of your data.
As part of the investigation into criminal law activities, VXM Retail required to provide data to the police. Think of an investigation into fraud or theft. We will also be obliged to provide personal details in case of a court order.
7.4 Marketing activities
It is possible that VXM Retail in the context of improving advertising and sales of certain products, a marketing agency is called. For further explanation see 'Marketing activities' (9).
8 Creditworthiness control
For the safety of VXM Retail and your security we use a company that can check your creditworthiness. We make use of this, because a certain certainty that the product is purchased is desirable. This is also a protection mechanism for both VXM Retail if you, because everyone benefits from a proper settlement of the agreement. The agency we use is Afterpay. You can contact both them and VXM Retail for a request for removal of your personal data.
9 Marketing activities
In the context of improving and directing offers, we may share your information with a specialized marketing agency. They take care of the data we provide for targeted or current offers that we send you. You have to agree to this yourself and you can of course easily unsubscribe yourself.
10 Children under 16 years
Are you younger than 16 years old? Then you can basically buy a product at VXM Retail, however, we as a company have decided not to sell products to persons under the age of 18. If you do want to order a product, we advise you to have one of your parents read this statement so that they know what happens to your personal data.
11 Right of the person concerned
As a customer you have a few important rights, also known as the right of the person concerned. The data subject's right gives you the opportunity to view, change or delete your data. VXM Retail is aware of the fact that this right is an extremely important part of your privacy and that your personal data must be handled carefully. VXM Retail therefore gives you the opportunity to contact us so that we can give you access to your personal data. You can also invoke the right of objection by objecting to the processing of your data. If you no longer want to use our service or no longer buy products then you have the option to have your data removed from our database. It goes without saying that your data will no longer be shared with third parties as explained under 'sharing with third parties'. If you wish to invoke any of the above rights against VXM Retail, you can make this known by means of a request addressed to us. Our contact details can be found under 'Contact details' (14). Your request will be processed as soon as possible.
12 Reporting obligation and Authority for Personal Data
If your data is lost or made accessible by unauthorized parties by a data breach, you will be informed of this if there is reason to do so. You can also suspect that VXM Retail contact the Dutch Data Protection Authority.
VXM Retail has the right to change this privacy statement and update it so that the statement complies with the rules in accordance with the Data Protection Act and the General Data Protection Regulation. It is therefore advisable to consult this statement from time to time. If there is a substantial change in this statement that has demonstrable consequences for you then you will be notified by e-mail.
